These terms are between Yaa Mansa LLC (“we”, “us”) and the business that signs up (“you”). Using Akye means agreeing to them.
Software for running a cleaning or field-service business: scheduling jobs, assigning crews, recording what they are paid, keeping checklists and standard procedures, and managing applicants and hiring.
It is a record-keeping tool. That distinction matters and section 5 explains why.
You are the one with the relationship with your customers and your workers, so some obligations can only be yours:

Akye records what you decide to pay somebody and can total it for the year. It does not pay anybody, withhold anything, file anything, or remit any tax. The figures it produces — including any 1099 totals — are a record of what you told it, for you and your accountant to check. They are not a filed return and they are not reviewed by anybody.
The software is built around paying people per job, which is common among cleaning contractors. That is not us telling you anybody is an independent contractor. Classification is a legal question about the real working relationship, it is decided by tests that differ by state and by federal agency, and getting it wrong is expensive. Using per-job pay in this software is not evidence of anything and must not be treated as such. Ask an employment lawyer or your accountant.
Akye can request a background check and store the result you upload. We do not perform checks, we do not obtain them, and we are not a consumer reporting agency. If you use background checks in hiring, the obligations under the Fair Credit Reporting Act and equivalent state law — the standalone disclosure, written consent, the pre-adverse-action notice and the waiting period before you act — are yours, and they apply whoever ran the check.
Card payments run through Stripe under your own Stripe account. We never see or store a full card number. Your relationship for those payments is with Stripe, on their terms.
The starting checklists, standard procedures, scripts, contractor agreements and customer terms included in the software are drafts written from one cleaning company's experience. They are a place to start, not documents prepared for your business, your state or your situation. Read them, change them, and have anything that matters reviewed.
Do not use Akye to send messages to people who have not agreed to receive them, to store data you have no right to hold, to break into or overload the service, or to resell access as your own product. We may suspend an account doing any of those — and we will tell you why and give you your data.
We aim to keep Akye running and we take nightly backups, but this is software and outages happen. There is no uptime guarantee on the plans listed publicly. If you need one in writing, ask.
We will fix faults as quickly as we can and tell you honestly what happened. But to the extent the law allows: the service is provided as it is, and our total liability to you for any claim is limited to what you paid us in the twelve months before it arose. We are not liable for lost profits, lost business or indirect losses.
Nothing here limits liability for anything that cannot lawfully be limited, including fraud.
We will email you at least 14 days before anything material changes. Continuing to use Akye after that means accepting the new version. If you would rather not, cancel and we will refund the unused part of the month.
These terms are governed by the law of Florida, and disputes go to the courts of Orange County, Florida. Talk to us first — akyecrm@gmail.com. Most things are a misunderstanding.
